James has more than 25 years of experience representing some of the country’s largest corporations in patent, intellectual property, consumer class action, employment and other complex commercial disputes in New Jersey state and federal courts. James spent over 20 years at one of the largest firms in the country, managing the firm’s New Jersey office for 17 years. James provides clients with this top quality “BigLaw” experience, advice and counseling in New Jersey courts, but at a fraction of the cost charged by major law firms.

James has practiced exclusively in New Jersey courts for his entire career. This experience, coupled with having appeared before virtually every District Court Judge and Magistrate Judge in New Jersey Federal Court, has provided James with a deep and meaningful knowledge of the Court, judges, opposing counsel and local nuance and practice. This depth of knowledge and experience has been considered a vital component of any litigation team representing clients in New Jersey matters. Clients and national counsel coming into New Jersey courts have said that they find this skill critically important. James is able to provide critical and sound strategic advice and guidance on all types of matters. He is considered an excellent sounding board on strategic decisions from the beginning of a matter through trial.
Coupled with his experience litigating matters as outside counsel, James also has significant in-house litigation counsel experience managing large, high-exposure and complicated litigation matters for one of the world’s largest telecommunications company. This combination provides clients with a unique and valuable perspective to effectively and efficiently handle their matters.

REPRESENTATIVE MATTERS

James has extensive experience representing clients in a wide variety of matters, including:

Patent
In recent years, a significant amount of James’ time has been spent litigating patent infringement matters in the pharmaceutical and biotechnology industries. This includes litigating billion-dollar patent and antitrust issues, as well as representing biosimilar and generic drug manufacturers in high-stakes patent proceedings related to the Biologics Price Competition and Innovation Act (BPCIA), the Hatch-Waxman Act, and in related regulatory proceedings before the FDA.
He has also litigated patent infringement matters involving non-pharmaceutical products, including pregnancy test kits, stock market order tracking devices and gift registry devices..

Intellectual Property
In addition to his patent litigation experience, James has litigated claims arising under state and federal unfair competitions laws, including Lanham Act false advertising claims, trademark infringement, and trade secret litigation. This includes successfully handling many temporary restraining order/preliminary injunction matters and other emergent applications.

Consumer Class Actions
James has defended many putative class actions in New Jersey federal and state court and other courts throughout the country in a variety of matters, including: (i) product liability claims (including UCC warranty claims) relating to high-definition televisions, front-loading washers, refrigerators, carbonated beverages, and cellular telephones; (ii) financial services; (iii) consumer fraud and state consumer protection/unfair trade practices statutes; (iv) labor and employment practices; and (v) consumer class actions.

This experience not only includes litigating these types of cases on an outside counsel basis, but also managing high-risk/exposure class actions as an in-house attorney. This involved managing outside counsel on a daily basis, as well as developing and implementing litigation strategy relating to removal, class certification, complex class discovery issues (including electronic discovery), arbitration, settlement and claims administration, class notice, and preliminary/final approval of class settlements.

Employment
James has represented clients in state and federal courts, as well as arbitration proceedings, in a wide variety of employment-related matters, including single-plaintiff and multi-party employment discrimination; wrongful discharge; ADEA, NJ LAD, and ERISA litigation matters; executive employment agreements; and noncompetition provisions, restrictive covenants, and other employment-related contracts.

James has first-chaired several non-compete/restrictive covenant matters in many different industries, including photographic films, medical devices and pharmaceuticals, where temporary restraints and preliminary injunctive relief were obtained.

General Commercial Litigation
James’ general commercial litigation experience spans many different areas of the law, including: environmental (CERCLA, RCRA, New Jersey Spill Act, Natural Resource Damages claims, Clean Water Act claims, and violations of OSHA regulations); insurance coverage (product liability, environmental and asbestos liabilities involving hundreds of millions of dollars of coverage at both the primary and excess coverage layers, and bad faith claims); antitrust; product liability; securities fraud; real estate development; professional liability; construction; maritime; breach of contract; and fraud and business torts.
